Accepting these terms
These terms apply when you use this website or hire Vertex Dickinson Concrete for concrete work. By browsing the site, sending us a request or booking a job, you agree to them, so please read them before you schedule anything.
If you don't agree with these terms, please don't use the site or book work with us. You can go back to the home page any time, or contact us with questions before you decide.
What we do
Vertex Dickinson Concrete is a concrete contractor in Dickinson, ND. We build driveways, patios, sidewalks, garage floors, steps, retaining walls, footings, foundations and other flatwork, which covers the flat slabs people drive and walk on. We also do decorative and stamped concrete, foundation raising and concrete cutting. You can read more about our crew on the about page.
The information on this site is general. It explains how concrete work usually goes, but it isn't advice for your property, because every yard, soil condition and slab is different until we see it in person.
Estimates and pricing
We give free on-site estimates, and there's no pressure to book. Your estimate is based on what we can see and measure on the day we visit, including the size of the slab, its thickness, the condition of the subgrade, which is the ground the concrete sits on, and any old concrete that has to come out.
Some things only show up once the job is open, such as soft or wet soil under the old slab, buried debris or hidden roots. If we find something like that, we'll stop, show you what we found and agree on any change in price with you before we do extra work.
An estimate is good for the time it states. After that, material and labor costs may have changed, so we may need to update it before we schedule your job.
Scheduling, weather and cancellation
We set a start date with you once you've approved the estimate. Concrete depends on the weather, so we may move a pour if rain, high heat, cold or wind would weaken the slab, and we'll tell you as soon as we know.
New concrete needs time to cure, which is the wait while it hardens and gains strength before you walk or drive on it. We'll tell you how long to stay off your new slab, and damage from using it early, such as tire marks or footprints, isn't covered by our work guarantee.
If you need to cancel or move your job, please call us at (701) 495-9954 as early as you can. If we've already ordered materials, set forms or brought equipment to your property, you may be charged for those costs, as your written estimate or agreement states.
Payment terms
Your written estimate or agreement lists the price, any deposit and when each payment is due. Unless it says otherwise, the balance is due when the work is finished.
If a payment is late, we may pause work that hasn't started yet until the account is current. You stay responsible for any costs we reasonably have to pay to collect an unpaid balance, as far as North Dakota law allows.
Your part of the job
We need clear access to the work area, and we need you to tell us about anything buried there that you know about, such as sprinkler lines, septic parts or private utility lines. Please also tell us where your property lines are if you know them, because we work from the information you give us.
Some jobs need a permit or approval from the city or your homeowners association. Please check what applies to your property before the work starts, and ask us if you're unsure what the job involves.
Our work guarantee and what it doesn't cover
We're licensed and insured, and we stand behind our work. Your satisfaction is guaranteed, which means that if something about the job we did isn't right, you call us and we'll come look at it and work with you to make it right.
Concrete can get small hairline cracks as it shrinks and moves with the seasons, even when it's poured well. We cut control joints, which are planned grooves that give the slab a place to crack in a straight line, but they can't stop every crack, and small cracks that don't affect how the slab works aren't defects.
Our guarantee doesn't cover damage from things outside our control, such as soil settling under areas we didn't prepare, flooding, heavy vehicles the slab wasn't built for, deicing salts, poor drainage from gutters or grading we didn't build, or changes someone else made later.
Except for what we put in writing for your job, our work and this website are provided as they are. As far as the law allows, we don't give any other warranties, spoken or implied, including implied warranties of merchantability or fitness for a particular purpose.
Limits on our liability
As far as the law allows, Vertex Dickinson Concrete isn't liable for indirect, incidental or consequential losses, such as lost use of your driveway while the concrete cures or lost income. Our total liability for any claim about a job is limited to the amount you paid us for that job.
We aren't responsible for damage to buried items nobody told us about, or for problems caused by information about your property that turned out to be wrong. Nothing in these terms limits any right you have that North Dakota law says can't be limited.
Using this website
You can use this site to learn about our work and contact us. Please don't copy its text or photos for commercial use, try to break into it or use it for anything unlawful.
We try to keep the site accurate, but it may have mistakes or out-of-date details. Links to other websites are there to help you, and we aren't responsible for what those sites say or do.
If we disagree
If you're unhappy with anything, please call us at (701) 495-9954 or use our contact page first, because most problems get settled fastest by talking them through on site. We reply within 1 business day.
If we can't settle it together, we both agree to try mediation in good faith before going to court. Any lawsuit has to be brought in the state or federal courts that serve Dickinson, North Dakota.
Governing law
These terms, and any job we do for you, are governed by the laws of the State of North Dakota, without regard to rules that would apply another state's laws.
If a court finds any part of these terms can't be enforced, the rest still applies.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one that applies. Changes don't affect a job you've already agreed to in writing, because that job follows the terms in place when you signed.
If you have questions about any part of these terms, reach us through the contact page or call (701) 495-9954. Our hours are Mon–Fri 8 AM–10 PM and Sat–Sun 6 AM–9 PM.
